Possible Bad ESN Verizon iP4S

I purchased a iPhone 4S secondhand. Trying to activate it and I get to the screen that says it's still linked to an apple id and that it needs to be deactivated. I have been unsuccessful at contacting the seller so my concern is that this phone may be lost or stolen. If I was to take it into a Verizon store would they be able to check it to see if in fact it is lost/stolen?
 
Even if Verizon sees that it's not stolen or lost, the device cannot be used. You've brought a dud. If you purchased it through a medium like Amazon or eBay or anything like that, you can return the device and get your payment back. Otherwise, the only thing you can do is use it as a paperweight, or sell it for parts to get a small amount back.
