Found phone after warranty was used

I dropped my iphone in the pool Friday and it's done. My friend thought he lost his phone a few months ago and used the warranty to get a new 4s. He has found his old 4s since then and gave it to me to use. When I took it to the carrier to get it activated they told me how the warranty has been used on the phone and said I could not use it. Is there any way around this? Will it help if I unlock the phone? Any advice would be appreciated.
 
Basically that phone belongs to apple now as it has been deactive due to warranty replacement within the service providers.

If its a newer baseband it can't be unlocked, but even if its the older one that could be unlocked, the phone will never activate due to apple deactivating it in the system.

That phone is a paper weight is all.

Even on a pay as you go it won't activate.

When apple gets phone back on warranty they then fix em if they can and then sends them to whomever needs one next. If the old phone is never returned to them, they black list it in the database = activation servers = itunes.
