Defective Iphone Headphones?

I bought the iphone 5c shortly after it came out and the phone works great... when the headphones are not in. The included headphones which came with the phone, keep turning up the volume by themselves: much to the aggrievement of my eardrums. Seeing as the phone works fine with other headphones in it seems I got a defective pair. How would i go about getting a replacement?

Additional Info:
-I bought the phone from the AT&T store but there is an apple store in my area.
-If i can settle the matter over the phone and have a replacement shipped that would be best.

All of Apple's products come with a one-year warranty, whether if it's the device/Mac itself, headphones, cables, etc, they will give you either a new or a replacement one. In the case of headphones, they'll give you a pair of new ones without charge. I don't believe AT&T supports replacement outside of device, and that's only if you purchase their insurance policy for the device alongside.
