It doesn't matter what firmware version your on its the baseband that counts. You could upgrade to any firmware you like as long as you preserve the baseband. If you upgrade without preserving your baseband then downgrade back, your baseband doesn't get downgraded. So you could be on 3.1.3 (I belive that's the latest you could be on for a easy unlock) or 4.3 and still have the unlockable 3.1.3 baseband or you could have downgraded from 4.3 to 3.1.3 but still have the unlockable 4.3 baseband.

Fortunately with the 3GS there is always the option of the iPad baseband if your on an unlockable 3GS baseband.

Sorry, I should of included it in my first post. I believe it's 5.12.xx. Remember there's always the iPad option but that comes with it's own problems.

If your already jailbroken search for ultrasn0w in cydia. It tells you in the description...

No. I want to know if I were to buy a new 3GS, will I be able to Unlock it. Not sure what you mean by Ipad option. If the phone has 4.1 with 4.1 baseband, i dont think anything will help me to Unlock that sob.

most likely new 3gs will have a 4.1v and UP

If you buy a new 3GS now it will most likley have 4.3 on it now or at least 4.2.1 which will be unlockable unless you upgrade the baseband to the iPad version.

This involves using a custom ipsw. The Dev team blog can explain it better than me...
