A factory unlocked iPhone will always be retail price. If you purchase a carrier unlocked one, you can use your upgrade. What carrier are ypu using and why do you want factory unlocked?

I'm with AT&T and planning to use it in Philippines. I bought the R sim 3 and sim card from Philippines and it doesn't work with my 4s. I will just sell my 4s and get the I5. I'm hoping to just shell out $200 for factory unlocked with my upgrade.

Nope. Even if you have an upgrade. And AT&T wont work on a factory unlocked iPhone.

You can buy an iPhone 5 from AT&T and they will unlock it. A factory unlocked iPhone is warranted by Apple. Is your 4S unlocked? If not, call AT&T for the unlock code.

No they wont. They only unlock off-contract iphones
