Outgoing calls not always working?

I just had to get a replacement iPhone 4s and when I go to ring someone it won't always ring... I've noticed the more frequently I make calls the less it does it prob 1 out of 6 calls wont work... And if I haven't used the phone for a while it's almost certain that the call will not work... I googled it and a lot of the posts about this problem are from middle to late last yr but there is a lot of them... My question is... Because I have not updated the phone to the current IOS could it be fixed in the update as this update didn't exist when the posts were made about this Problem or am i going to have to go through the pain of getting another replacement iPhone

Well i would update it to the current IOS anyway unless you are thinking of jailbreaking.

No I don't want to jailbreak it. I'll try do it today and hopefully the problem will b fixed thanks

I took it to a tech guy and he did the latest update and restored the phone and it seems to b working fine now
