Just realized something..
It's possible to have the same modem firmwares in two iPhones and yet one is factory unlocked and the other locked.. Ie my iPhone 4S baseband- 2.0.12 and a friend is the same yet his is locked and mine factory unlocked.. Or am I mistaken?

Yep this is entirely possible. Factory unlock is different from other unlock methods. And can be done to any iOS on any baseband.

So the question arises, how do you know whether a phone is factory unlocked or not?

There's a couple ways. I'm sure apple has a database of unlocked imei's. there's a couple websites that will retrieve that info as well. Free iPhone IMEI Checker with Locked status shown :: dev.mk just input your imei and click check. your results will be posted at bottom of the page.
But since you have a 4s on a non software unlockable bb, I would assume that if you are using it with a non supported SIM that it is factory(carrier) unlocked..
