Is there any way to completely reflash a phone which is locked to the previous owners icloud. Bought it off marketplace and the man doesnt know his late sons info.
 
Unfortunately, there is no way to circumvent activation lock. Even Apple could not do it.

A word of warning. There are some unscrupulous individuals who pop up every now and then, claiming to be able to get you into your phone, for a price. Don't throw good money after bad. The phone is useless.
 
You could try taking the phone to an Apple Store, armed with enough evidence that you are the legitimate owner of the phone. If there is anything that can be done, that's the place that could do it. It's a long shot, though. Everything I've heard indicates to me that it is not possible to remove activation lock without access to the original owner's AppleID.

Edit: In your shoes, I would be looking for a refund. You have been sold something that is not fit for the intended purpose.
 
In order to remove the activation lock without the Apple ID, you would need the original purchase receipt. If you can manage to get that, you could submit the form that @KevinJS posted. Without it, the phone is a paperweight and I would try to get your money back.
