trouble restoring 4s - is it stolen??

I recently bought a used 4s (ios 7.02) from a shop while I was in holiday in Myanmar - I thought it would ok because it was a shop but now i am not so sure. the first dumb thing I did was not to ask to have the phone restored to factory settings. Now when i try to do that from the phone i get apple id required. When I try from itunes it asks me to turn off the 'find my iphone' When i do that it asks me for the password again. When I go to the account, I can see the encrypted icloud password! I'm worried that the phone is stolen, but if that was the case why would the seller leave a whole lot of contacts on it? I have tried to contact the seller but no reponse which does make me suspicious. Any advice?

More than likely the device is either stolen or the seller reported it as stolen to claim the insurance portion for a device replacement. Never buy devices from unauthorized sellers unless it's guaranteed to be cleaned out, particularly with the iOS 7 changes
