Is there a way to tell what sim card you need for your iPhone if I got it from someone and I dont know about its history?

If you have access to your device you can find out in Settings.app > General > About and scroll down to carrier. Otherwise you might need an IMEI checker

I activate my iPhne but it says it needs a sim card, is there a way to do it without the sim?

To activate without a SIM, you need to hacktivate your device by jailbreaking it using RedSn0w
